Proving Liability

To prove liability in a trucking accident case, four elements must generally be established:

Duty of Care

The at-fault driver owed a duty of care toward the victim. Drivers must take precautions like staying sober, staying focused, keeping braking systems maintained, and following required rest periods.

Breach of Duty

Causation
